Trump administration bans Chinese, other Communist Party members from immigrating to US

The Trump administration has banned card-carrying members of the Chinese Communist Party and other communist and totalitarian regimes from immigrating to America.

The feds implemented the measure following months of agitation from their Chinese counterparts and the communist regime’s refusal to take responsibility for the coronavirus pandemic. Other communists, such as those belonging to the Maduro regime in Venezuela and North Korea’s government, are also expected to be impacted by the ban.

The policy change, which occurred on October 2, cites a ban on individuals with affiliations to a “Communist Party or any other totalitarian party” that is “inconsistent and incompatible with the Naturalization Oath of Allegiance.”

Operating under the auspices of the Trump administration, the U.S. Citizenship and Immigration Services (USCIS) outlined the new policy guidance in the USCIS policy manual to address the ban. The USCIS stated:

 

On Oct. 2, USCIS issued policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. Membership in or affiliation with the Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America, which includes pledging to “support and defend the Constitution and laws of the United States.”

The new policy manual section provides guidance on how to adjudicate inadmissibility due to membership in the Communist Party or any other totalitarian party in the context of adjustment of status applications.

In general, unless otherwise exempt, any intending immigrant who is a member or affiliate of the Communist Party or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. This addition to the policy manual will help officers adjudicate this inadmissibility ground consistent with federal law.
