Mr Cornelius has previously declared protests illegal as they are "not one of the four permitted reasons to leave home".
Kerry Cotterill is among hundreds who have previously been fined for protesting while complying to the Cheif Health Officer directives.
The backflip comes days before our constitutional challenge on the legality of protesting is set to be heard in the Supreme Court.
Tomorrow protests are planned in Melbourne's CBD.
