Premier Smith responds to Liberals' plan to appeal 'unconstitutional' Emergencies Act ruling
Alberta Premier Danielle Smith has released a statement in response to the Liberal Party’s decision to appeal a ruling in Canada’s Federal Court.
Yesterday, Justice Richard Mosley determined that Justin Trudeau’s invocation of the Emergencies Act was unconstitutional. Not hours later, Deputy Prime Minister Chrystia Freeland announced on behalf of Trudeau’s government that the decision would be appealed.
As expected, Prime Minister Trudeau hid himself from criticism.
Deputy PM Chrystia Freeland says the Liberals will appeal the Federal Court decision which ruled the govt unconstitutionally invoked the Emergencies Act.

Freeland says the Liberals remain convinced it was the "right" and "necessary" decision.https://t.co/vD78U4ZuZQ pic.twitter.com/FXGhN50SWr

Trudeau’s government faced an onslaught of backlash for their decision to appeal this ruling – let alone the backlash for implementing the Emergencies Act in the first place – including from Alberta’s Premier Danielle Smith.
Court sides with Alberta: Liberal use of Emergencies Act Unconstitutional

I have issued the following statement with Minister of Justice Mickey Amery in response to the Federal Court’s decision on the invocation of the Emergencies Act:

Premier Smith highlights the stance Alberta has taken on the Emergencies Act since its invocation, that it was not needed, violated constitutional rights, and gave incredibly overpowered abilities to the federal government without due process of law.
Alberta is filing a Court challenge to the unjustified use of the Emergencies Act.

We may also intervene in support of other Court challenges.
As Tommy Douglas said about the use of the War Measures Act in 1970, it’s like “using a sledgehammer to crack a peanut. https://t.co/lx53TNcaJb pic.twitter.com/QD98vKgc32
Smith also highlights the reality which is, Trudeau has a continuing history of using the legal system to promote politically ideological campaigns. The Liberal plastic straw ban was overturned by the Federal Court as well, and again Trudeau’s government is appealing this decision.
Likewise Premier Scott Moe of Saskatchewan sheds light on the federal government’s continued pursuits against Canadians.
The Supreme Court today ruled that the federal government “overstepped its constitutional competence” and the federal Impact Assessment Act is unconstitutional.

This should cause the federal government to rethink the many other areas where it is overstepping its constitutional… pic.twitter.com/aAXO0x9wYX
Saskatchewan’s plan for affordable, reliable power generation may require coal-fired generation beyond 2030.

Steven Guilbeault says that would be illegal.
Here’s my response to that. pic.twitter.com/IDMRIi3qxM
Justin Trudeau invoked the Emergencies Act during the Freedom Convoy, and this caused peaceful demonstrators to be violently arrested, vehicles and bank accounts to be seized, and our rights and freedoms to be stripped overnight. Regardless of whether Trudeau’s government wins an appeal using your tax money, it’s clear Trudeau does not respect the rights of Canadians, or even premiers.
